These Terms of Service (“Terms”) govern your access to and use of the website located at exerciseinnovation.net (the “Website”), including any content, features, applications, programs, physical products, and services offered through it (collectively, the “Services”).
The Services are operated by EI Sports, LLC, a limited liability company organized under the laws of the State of Michigan (“Company,” “we,” “our,” or “us”).
By accessing or using the Website, creating an account, purchasing a program, product, or booking a session, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Website or any of our Services.
1. Services and Products Overview
Exercise Innovation provides sports performance training programs, mental performance training programs, 1-on-1 coaching sessions, educational content, downloadable guides, physical products, and related digital services designed for competitive athletes at all levels.
Digital Programs and Services:
- Training Programs — Multi-week, phased conditioning programs (e.g., ACL Recovery, Soccer Off-Season, Hockey Off-Season) delivered through our platform with video demonstrations, progress tracking, and downloadable resources.
- Mental Performance Program — An 8 to 12 week mental skills training program covering visualization, breathing techniques, self-talk, goal setting, and emotional regulation.
- 1-on-1 Coaching Sessions — Individual coaching sessions with Coach Dave Boyer for personalized mental performance guidance, priced at the rate listed on the Website at the time of booking.
- Digital Resources — Training manuals, educational content, blog articles, and other downloadable materials available through the Website and app.
Physical Products:
- We sell physical merchandise and training equipment through our online store, including but not limited to branded apparel (hoodies, clothing), balance boards, and other performance-related products. All physical products are subject to the return and refund terms outlined in Section 5 of these Terms.
We reserve the right to modify, suspend, or discontinue any part of the Services or product offerings at any time without prior notice.
2. Account Registration and Security
To access certain features of the Services, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and update your information to keep it accurate and current.
- Keep your login credentials confidential and not share them with any third party.
- Accept responsibility for all activity that occurs under your account.
- Notify us immediately at Support@exerciseinnovation.net if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate your account at any time if we reasonably believe that your account information is inaccurate, that you have violated these Terms, or that your account has been compromised.
3. Age Requirements
The Services are available to users of all ages. However, children under the age of 13 must use the Website and Services only with the permission and supervision of a parent or legal guardian. By allowing a child under 13 to use the Services, the parent or guardian agrees to these Terms on behalf of the child and accepts full responsibility for the child’s use of the Services.
If we become aware that a child under 13 is using the Services without verifiable parental consent, we may terminate that account and delete associated data.
4. Purchases, Payments, and Pricing
All purchases made through the Website, including program enrollments, 1-on-1 coaching session bookings, and physical product orders, are processed securely through Stripe. We do not store your payment card details on our servers.
By making a purchase, you agree that:
- All pricing is listed in U.S. Dollars (USD) unless otherwise stated.
- Prices are subject to change at any time without prior notice. However, price changes will not affect purchases already completed.
- You are responsible for any applicable taxes, shipping costs, and duties associated with your purchase.
- You authorize us to charge the payment method you provide for the total amount of your purchase.
- For physical products, shipping times and costs will be displayed at checkout. Delivery timelines are estimates and may vary based on location and carrier availability.
5. Refund, Return, and Cancellation Policy
We want you to feel confident in every purchase. Our refund and return policies are straightforward and vary by the type of purchase.
5.1 — Digital Programs (Training and Mental Performance)
- A full refund is available if you request cancellation before any program content has been accessed. Once you access any part of a program (including viewing videos, downloading materials, or logging into the program dashboard), the purchase is considered final and no refund will be issued.
5.2 — 1-on-1 Coaching Sessions
5.3 — Physical Products (Apparel, Equipment, and Merchandise)
- You may return any physical product within 7 days of delivery for a full refund, provided the item is unused, unworn, unwashed, and in its original packaging with all tags attached.
- Items that show signs of use, wear, washing, damage, or alteration will not be accepted for return.
- Balance boards and training equipment must be returned in their original packaging, unused, and in resalable condition. Equipment that has been assembled, used, or shows any signs of wear is not eligible for return.
- Custom or personalized items (if applicable) are final sale and cannot be returned.
How to Initiate a Return:
- Contact us at Support@exerciseinnovation.net within 7 days of receiving your order.
- Include your name, order number, the item(s) you wish to return, and the reason for the return.
- Our team will respond with return shipping instructions within 2 business days.
- Ship the item(s) back in their original condition and packaging. Return shipping costs are the responsibility of the buyer unless the item arrived damaged or defective.
- Once we receive and inspect the returned item(s), your refund will be processed to your original payment method within 7 to 10 business days.
5.4 — Damaged or Defective Products
- If you receive a physical product that is damaged, defective, or incorrect, contact us at Support@exerciseinnovation.net within 48 hours of delivery with photos of the issue.
- We will provide a prepaid return label and send a replacement or issue a full refund at no additional cost to you.
5.5 — General Refund Requests
- For any refund request not covered above, contact us at Support@exerciseinnovation.net with your name, the item or service purchased, and the reason for your request. All requests are reviewed on a case-by-case basis.
6. Shipping and Delivery (Physical Products)
- Physical products are shipped to the address provided at checkout. It is your responsibility to ensure the shipping address is accurate and complete.
- Estimated delivery timelines are provided at checkout and may vary based on your location and carrier conditions.
- We are not responsible for delays caused by the shipping carrier, weather, customs, or incorrect addresses provided by the buyer.
- Risk of loss or damage to physical products passes to you upon delivery to the shipping carrier.
- If a package is marked as delivered but you have not received it, please contact the shipping carrier first. If unresolved, reach out to us at Support@exerciseinnovation.net and we will work with you to find a solution.
7. User Conduct and Responsibilities
By using the Services, you agree that you will:
- Use the Services only for lawful purposes and in accordance with these Terms.
- Not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content, materials, or intellectual property from the Website without our prior written consent.
- Not share your account access, program content, training videos, downloadable guides, or any proprietary materials with any third party.
- Not attempt to gain unauthorized access to any part of the Website, other accounts, or any systems or networks connected to the Website.
- Not use the Services to transmit any harmful, offensive, or illegal content.
- Not interfere with or disrupt the Website, servers, or networks connected to the Services.
We reserve the right to terminate or restrict your access to the Services at any time, without notice, for any conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties.
8. Intellectual Property
All content on the Website, including but not limited to text, graphics, logos, images, videos, training programs, downloadable guides, program structures, coaching frameworks, product designs, and software, is the property of EI Sports, LLC or its content creators and is protected by United States and international copyright, trademark, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services and content for your personal, non-commercial use only. This license does not include the right to:
- Resell or commercially use any content, materials, or products.
- Copy, reproduce, or distribute program content in any form.
- Record, screen-capture, or redistribute coaching sessions or training videos.
- Use our trademarks, logos, or brand elements without written permission.
Any unauthorized use of our content terminates the license granted herein and may result in legal action.
9. Data Collection and Use
We collect and use certain personal information to provide and improve the Services. By using the Website, you acknowledge and agree that we may collect:
- Account Information — Your name and email address, collected during account registration.
- Payment Information — Payment details are processed securely through Stripe. We do not store your full payment card information on our servers.
- Email Subscriptions — If you subscribe to our mailing list, your email address is stored and managed through Mailchimp for the purpose of sending program updates, educational content, and promotional communications.
- App Progress Data — If you use our platform to track your training, your workout progress, session completions, and related activity data are stored within the app to provide you with progress tracking and program customization.
- Shipping Information — If you purchase physical products, your shipping address and contact details are collected for order fulfillment and delivery purposes.

10. Health and Medical Disclaimer
Exercise Innovation is not a medical provider. Our programs, coaching sessions, products, content, and materials are designed for educational and informational purposes related to sports performance and mental performance training. They are not a substitute for professional medical advice, diagnosis, or treatment.
By using the Services, you acknowledge and agree that:
- You should consult with a qualified healthcare professional before starting any exercise program, especially if you have a pre-existing medical condition, injury, or health concern.
- All training programs involve inherent physical risks, including but not limited to muscle strain, joint injury, cardiovascular stress, and other physical injuries. You voluntarily assume all risks associated with participating in any training program.
- Physical training equipment purchased through our store (including balance boards) should be used according to provided instructions and with appropriate safety precautions. EI Sports, LLC is not responsible for injuries resulting from improper use of equipment.
- Mental performance training provided through the Services is not psychotherapy, counseling, or clinical psychology. It is performance coaching designed to develop mental skills for sport. If you are experiencing a mental health crisis, please contact a licensed mental health professional or call emergency services immediately.
- We do not guarantee specific results from any program, product, or coaching session. Individual results vary based on effort, consistency, physical condition, and other factors beyond our control.
- Coach Dave Boyer holds credentials as an Athletic Trainer (ATC) and Certified Strength and Conditioning Specialist (CSCS) with over 30 years of professional experience. His coaching is based on his professional expertise, but it does not constitute medical treatment or clinical mental health services.
11. Assumption of Risk and Liability Waiver
By participating in any Exercise Innovation program, session, or activity, or by using any physical product purchased through our store, you acknowledge that physical exercise and the use of training equipment carry inherent risks and you voluntarily assume full responsibility for any risks of injury or illness that may result from your participation or product use.
To the maximum extent permitted by applicable law:
- EI Sports, LLC, its owners, employees, coaches, contractors, and affiliates shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or products, participation in any program, or attendance at any session.
- You agree to release, waive, and discharge EI Sports, LLC from any and all claims, demands, or causes of action arising out of your use of the Services or products, except in cases of gross negligence or willful misconduct.
12. Third-Party Services
The Website may contain links to third-party websites, services, or tools that are not owned or controlled by EI Sports, LLC. These include but are not limited to:
- Stripe — for payment processing
- Clerk — for authentication and account management
- Mailchimp — for email marketing and subscriptions
- Google Analytics — for website analytics
- Shipping Carriers — for physical product delivery
We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is governed by their respective terms and policies. We encourage you to review their terms before using them.
13. Termination
We reserve the right to terminate or suspend your access to the Services at any time, with or without cause, and with or without notice. Reasons for termination may include but are not limited to:
- Violation of these Terms.
- Fraudulent or illegal activity.
- Sharing account access or program content with unauthorized users.
- Abuse of the return or refund policy.
- Conduct that is harmful to other users or to the Company.
Upon termination, your right to use the Services will cease immediately. Termination does not affect any pending physical product orders that have already been shipped. Any provisions of these Terms that by their nature should survive termination will remain in effect, including but not limited to intellectual property, liability limitations, and dispute resolution.
14. Disclaimer of Warranties
The Services and products are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, EI Sports, LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Services will be uninterrupted, error-free, or secure.
- Any defects in the Services will be corrected.
- The results obtained from the use of the Services or products will be accurate or reliable.
- The quality of any programs, coaching, products, content, or materials will meet your expectations.
- Physical products will be free from defects (though defective products are covered under our return policy in Section 5.4).
15. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall EI Sports, LLC, its owners, directors, employees, coaches, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from:
- Your use of or inability to use the Services or products.
- Any unauthorized access to or alteration of your data.
- Any content or conduct of any third party on the Services.
- Any injury or damage resulting from the use of physical products purchased through our store.
- Any other matter related to the Services.
Our total liability to you for all claims arising from or related to the Services shall not exceed the total amount you paid to EI Sports, LLC in the twelve (12) months preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless EI Sports, LLC, its owners, directors, employees, coaches, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:
- Your use of the Services or products.
- Your violation of these Terms.
- Your violation of any rights of a third party.
- Any content you submit or transmit through the Services.
- Any injury or claim arising from your use of physical products.
17. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States of America, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall first be attempted to be resolved through informal negotiation by contacting us at Support@exerciseinnovation.net. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through binding arbitration or in the state or federal courts located in the State of Michigan.
You agree that any legal action or proceeding related to these Terms shall be brought exclusively in the courts of the State of Michigan, and you consent to the jurisdiction of such courts.
18. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we make changes, we will update the “Effective Date” at the top of this page. Your continued use of the Services after any changes are posted constitutes your acceptance of the revised Terms.

19. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
20. Entire Agreement
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and EI Sports, LLC regarding your use of the Services and supersede all prior agreements, understandings, and communications, whether written or oral.
